1. Agreement to Terms

By using our services ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We may modify the Terms at any time, and such modification shall be effective immediately upon posting of the modified Terms.

2. The Service

NeedTexting provides a platform for sending and receiving communications, including but not limited to SMS, MMS, and Fax, along with tools for contact management, AI-powered message generation, and analytics (the "Service"). You are responsible for obtaining and maintaining all telephone, computer hardware, and other equipment needed for access to and use of the Service and all charges related thereto.

3. User Accounts

To use the Service, you must register for an account. You agree to provide us with accurate, complete, and updated registration information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure.

4. Billing and Payment

Certain aspects of the Service may be provided for a fee or other charge. These include, but are not limited to, monthly number rentals and per-message usage fees.

  • Subscriptions: Number rentals are billed on a recurring, monthly basis. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Your Subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it.
  • Usage Fees: Fees for sending messages (SMS, MMS, Fax) are charged as described on our pricing page. Mass sends may be charged immediately to your payment method on file. Other usage may be accrued and billed when your balance reaches a certain threshold.
  • Payment Method: A valid payment method, including credit card, is required to process payment for all paid services. You represent and warrant that you have the legal right to use any credit card(s) or other payment method(s) utilized in connection with any transaction.

5. Acceptable Use

You agree to use the Service in compliance with all applicable laws and regulations, including but not limited to the Telephone Consumer Protection Act (TCPA) and CTIA guidelines. You are solely responsible for the content of your messages and for obtaining all necessary consents from your contacts. Please see our Acceptable Use Policy for more details.

6. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

In no event shall NeedTexting, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
